Booking Terms and Conditions for Tourist Rentals

  1. Pattern's Application.

    The present contract follows the law of Tourist Apartments, Bungalows and Villas, and the common Law for tourist rentals.
  2. This Agreement

    These Terms of Service together with all updates and any Additional Terms applicable to Your use of Villas España Estates Website, Products or Services, collectively constitute the legal agreement between You and Villas España Estates. To agree to these Terms of Service, click "Agree" or sign the contract. If You do not agree to these Terms of Service, do not click "Agree" nor sign the contract, and do not use the Products or Services. Please make sure You have read and agreed to this Terms, the Privacy Policy, the Legal Notice, and any other Additional Terms which apply to Your use of Villas España Estates Website, Products or Services. In some countries the Products or Services may be provided by our local partner. If so, You will be asked to accept the partner’s own terms of services, which will supersede these Terms of Service in case of conflict.

  3. Lodging.

    The lodging have to comply with the conditions established in the web page: http://www. villasespanaestates.com.
  4. Services annexed to the lodging.

    The lodging includes the pacific enjoyment of itself, the services and settings annexed to it. In the rental price are always included:
    1. Water up to 20 m3 per week;
    2. Electricity up to 200Kw per week;
    3. Two tanks of gas (if the lodging has them);
    4. Pool caretaker and gardener (if needed);
    5. Key collection;
    6. Bed linens and bath towels (if contracted);
    7. and it must be given clean and disinfected.
  5. Complementary service.

    Villas España Estates can give to the clients all complementary services it thinks convenient, publicizing the prices, and adding them to the booking confirmation or invoice form.
  6. Global price.

    All the prices for the lodging and for the complementary services will be global, including taxes belonging to the activity and what is mentioned in point number 3, if not stated differently in the contract.
  7. Payments and booking.

    1. Payments will be made by bank transfer to the account number specified in the contract. The following data will be specified: full name of the reservation holder, renting dates and name of the rented house. The client will notify the Company by fax or email, specified in the contact section of this web page, of all payments made.
    2. The total amount of the price must be paid by the client before the moment of the occupation of the lodging and, if there has been a down payment, this must be withdrawn from the global cost at the moment of the end payment. To confirm the booking of the lodging, the client has to sign the contract and send it back, then pre-pay 40% of the total amount at the moment of reservation if this is done more than one month before the beginning of the stay and 60% one month before the beginning of the stay. If the booking is reserved less than one month before the beginning of the stay the price must be paid in full.
    3. In case of cancellation of the booking confirmation, the Agency can hold for reimbursement 20% of the whole price, when the cancellation takes place more than 30 days before the beginning of the stay, and 50% when the cancellation takes place less than 30 days and more than one 7 days from the beginning of the stay. If the cancellation takes place less than 7 days before the beginning of the stay, the Company can hold the whole amount as reimbursement.
    4. The Company will be no more obliged to hold the lodging's booking if this will not be occupied within 48 hours from the date it has been booked for.
  8. Take possession of the lodging.

    The right to take possession of the lodging will begin, if not different contracted, from 5 p.m. on of the first day of the contracted period, and it will end at 10 a.m. of the last day of the contracted period. Please don't forget to bring the payment vouchers and the booking contract to present them at your arrival.
  9. State of the lodging in its occupancy day.

    The lodging will be at disposal of the client from the first day of the beginning of the rental period, in good working conditions, and cleanliness that permit its immediate use. Nevertheless all the services described in point 3, must be disposed by Villas España Estates at the time of the occupation of the lodging. The customers agree with the furniture's and household goods which are in the house, like their good quality and utility, if they don't complaint in the first 48 hours.
  10. Damage deposit.

    1. To replace the loss or the damage of some installations for example, but not limited to: furniture's or household goods, scratches and dirt on the walls, etc., damaged by the client during their stay, which are attributable to customers, as well as compliance with other contract liabilities, the Agency pretends from the client, before the beginning of the stay, a deposit, which amount is defined in the contract.
    2. The payment of the damage deposit can be made either by bank transfer one week before the arrival or on the day of arrival with a valid credit card. The client will have to notify his/her preference not less than one week before arrival.
    3. In case the choice is the first method, on the arrival day, the client will be attended preferably upon those ones who decided the second option, in order to get the keys of the lodging.
    4. In case the choice is the second method, the client will have to pay the amount of the damage deposit with a valid credit card in the meeting point accorded by the parts and he/she will give priority to those ones who chose the first method. Please remember that our staff cannot accept cash so please check the availability of your credit card before you go, to avoid any possible delay of whom Villas España Estates will not be held liable, according to the causes exposed under point number "9.g" in these conditions.
    5. The meeting point will never be the address of the booked accommodation unless stated differently in the contract.
    6. The client agrees to wait his/her turn to be attended by our personnel until we check that all the payments have been cleared, in order to get the keys of the lodging.
    7. The Company cannot deliver the keys of the lodging nor bring the clients to its place prior to have received 100% of the damage deposit and the whole amount of the reservation.
    8. At the end of the contract, and after the lodging has been evacuated, cleaned and checked, the Company will return the amount, less the deductions due to the case. In the best case the Company needs at least 48 hours to manage the reimbursement of the damage deposit. Because of this and that there are many reservations to deal with, please understand that Villas España Estates cannot reimburse the damage deposit the day of departure. Please note that it may take more than one week to return the deposit due to bank timings and office managements so, we kindly ask our clients to be patient in this respect.
  11. Necessary repair for the good conservation of the lodging.

    Clients should facilitate the entry of professional staff into the lodging, duly authorized by Villas España Estates or the owner, to proceed with the maintenance or repairs of the property needed in order to keep it in good conditions, being obliged to tolerate the required repairs and maintenance.
  12. Loss of the lodging conditions.

    If the lodging will not maintain the good conditions once the customer entered in it and not for client's fault, the client can choose to cancel the contract and be refunded the total amount he paid for the whole period, if the Agency cannot move him into another lodging of the same characteristics.
  13. Vacate of the lodging.

    When the contracted period and the eventual extensions established between the Agency and the clients have run out, the clients have to leave the lodging. The Agency has the right to perceive, as reimbursement, an amount three time as big as the one due to the days of the illegal occupancy of the lodging. Moreover the Agency can exercise the right to quit all the services included in point number 3, due to the end of the contract and can prosecute the clients civil and penally.
  14. Prohibitions to the clients:

    1. To introduce additional people in the lodging than the ones authorized by the fixed lodging's capacity;
    2. To put furniture inside the lodging or to take out the furniture from it;
    3. To put the mattresses on the ground, either inside or outside the house;
    4. To do works or repairs no matter how small they can be, without the written permission of the Agency.
    5. To throw objects in the swimming pool, such as, but not limited to: cans, glasses, bottles, furniture, grease, food, paper, stones, etc., as this can damage the walls of the pool and overcharge the water purifier;
    6. To clean diving suits, rubber dinghy, etc. in the pool or in the bathroom, because this damages the water purifier and blocks the cleaning of the swimming pool or it may clog the pipes;
    7. Perform the activity of hosting in the lodging, or designate it to a different purpose of the contracted one;
    8. To introduce explosive or burning material or substance or other material that can harm the guests, the property and the neighbourhood;
    9. To realize activities that attempt the standard pattern of living together with others, morality, decency, and public precept. As an example: to make loud noises or play loud music after midnight;
    10. To introduce animals if the Agency does not allow it expressly;
    11. To use, without the written Company's authorization, machines that will noticeably increase the utilities of water, electricity and gas or fuel;
    12. To clean the cars with a hose;
    13. To soil the tapestry of the sofas, arm chairs, curtains, the interior and exterior walls of the house;
    The unfulfillment of the clients regarding one or more of these prohibitions established in this article, will empower Villas España Estates to cancel the contract, keep the damage deposit to pay damages or/and fines, as reimbursement. In any case, if the damage produced by the client/s could not be fulfilled with the damage deposit delivered, the client/s undertakes to pay the remaining amount, having been informed in advance with a budget.
  15. The Agency is not responsible for:

    1. Burglar or break in the lodging during the client's stay, with money or stuff stolen by the burglars;
    2. Noises outside the property, due to “fiestas”, traffic or buildings that are out of the control of the Company;
    3. Cut of water or electricity due to causes exteriors of the lodging, as overcharge on the exterior line, bad weather, working in the line, breakage in the pipelines on the street, etc.
    Therefore no refund will be given for any of these complaints, neither there will not be any possibility to cancel the stay, nor to change the lodging if we don't have another one available.
  16. Warning about the consumption of water and electricity.

    Water and electricity are very valuable elements in the world and they are also very expensive supplies in some places (like "The Costa Blanca" in Spain, for example), therefore we ask you kindly to be very careful in the use of the air conditioning and the lights, the use of the washing machine and the dishwasher only when really needed, and watch for the water in the swimming pool or using the hose..., not to waste it. The misuse of these supplies can take even to a temporary suspension of them and the excessive use of them will be charged to your damage deposit.
  17. Garbage bags.

    Please throw the garbage bags daily into the appropriate containers that are on the street or in specific places of the urbanization, as the final cleaning fee does not include the garbage disposal. In case we find garbage bags in the house after you leave, it will be penalized with an extra charge of 100€ from the damage deposit.
  18. Miscellaneous.

    1. Entire Agreement:

      The terms and conditions of these Terms of Service and any applicable Additional Terms constitute the entire agreement between You and Villas España Estates with respect to the subject matter hereof and will supersede and replace all prior understandings and agreements, in whatever form, regarding the subject matter. Nothing in this clause shall exclude or restrict the liability of either You or Villas España Estates arising out of fraud or fraudulent misrepresentation.
    2. Partial Invalidity:

      If any provision of these Terms of Service, or any part of a provision, is found by any court or administrative body of competent jurisdiction to be illegal, invalid or unenforceable, and the provision (or part-provision) in question is not of a fundamental nature to the Terms of Service as a whole, the legality, validity or enforceability of the remainder of the Terms of Service (including the remainder of the term which contains the relevant provision) shall not be affected.
    3. No waiver:

      The failure to exercise, or delay in exercising, a right, power or remedy provided by the Terms of Service or by law shall not constitute a waiver of that right, power or remedy for Villas España Estates. If Villas España Estates waives a breach of any provision of the Terms of Service this shall not operate as a waiver of a subsequent breach of that provision, or as a waiver of a breach of any other provision.
    4. Assignment:

      You are not allowed to assign the Terms of Service or any rights hereunder. Villas España Estates is allowed at its sole discretion to assign the Terms of Service or any rights hereunder to any third party, without giving prior notice.
    5. Applicable Law and Competent Court.

      The Terms of Service shall be governed by and interpreted in accordance with the laws of Italy and any dispute arising out of the application of the present contract shall be subject to the jurisdiction of the courts of Florence (Italy).
    6. Language:

      The original English version of the Terms of Service may have been translated into other languages. In the event of inconsistency or discrepancy between the English version and any other language version, the English language version shall prevail.

Villas España Estates has the right to alter, modify or replace any content of this web page, including these General Conditions at any time without prior notice, being effective only the last published update.
Your continued use of this website or any contracted service constitutes your consent to the contents of this notice, as it may be modified from time to time.

You expressly acknowledge that you have read this agreement and understand the rights, obligations, terms and conditions set forth herein. By clicking on the "Accept" button, signing the contract or by using the Products or Services, you expressly consent to be bound by its Terms and Conditions and grant to Villas España Estates the rights set forth herein.
